Terms of Service

Welcome to EuroserPOD Store (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of store.euroserpod.com and related services (the “Site” and the “Services”). By using the Site, you agree to these Terms and to our Privacy Policy and Refund/Returns Policy (collectively, the “Policies”). If you do not agree, do not use the Site.

1) Eligibility & Accounts

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.

• You agree to provide accurate, complete, and current information for your account and orders, and to maintain the confidentiality of your login credentials.

• We may refuse service, close accounts, or cancel orders at our sole discretion, including for suspected fraud or policy violations.

2) Our Products & Personalization

We produce custom, made-to-order items (e.g., rugs, bath mats, towels, blankets, doormats) using your designs or our templates.

• Color & Material Variation: Due to screen settings, textile substrates, print profiles, and batch dye differences, minor color and tone variations are expected and are not considered defects.

• Size Tolerance: Finished dimensions may vary by approximately ±2–3 cm due to textile cutting and stitching tolerances.

• Design Placement: Small shifts in design placement/scale can occur within standard manufacturing tolerances.

3) User-Generated Content & License to Print

You may upload images, text, graphics, or other content (“User Content”) to create personalized products.

• You own your content. You represent and warrant that you either own the rights to the User Content or have sufficient licenses/permissions to use it for the intended purpose.

• License you grant to us (for fulfillment): You grant us a non-exclusive, worldwide, royalty-free license to reproduce, modify (solely as needed for production: scaling, color management, cropping), and distribute the User Content only to manufacture and deliver the products you order, and to provide customer support for that order.

• Prohibited content: You may not upload content that is illegal; infringing; defamatory; hateful; harassing; obscene; sexually explicit involving minors; promotes violence or terrorism; or includes third-party logos/marks, celebrities, or copyrighted works without permission.

• Moderation: We may refuse, cancel, or remove orders and content at our discretion if we believe they violate these Terms or applicable law.

• Indemnity: You agree to indemnify and hold us harmless from claims, costs, and liabilities arising from your User Content (including IP infringement or rights of publicity/privacy).

4) Intellectual Property (Our IP)

All non-user content on the Site—including our designs, templates, product mockups, text, graphics, logos, and software—is owned by or licensed to us and protected by IP laws. You may not copy, distribute, or create derivative works from our content without prior written consent.

5) Ordering, Processing & Cancellations

• Order review: Please review your design, spelling, and layout carefully before checkout. We produce exactly as submitted, unless we contact you for an issue.

• Processing times: Typical production time is 1-2 business days (not guaranteed). Large orders or peak seasons may take longer.

• Cancellations/Changes: Requests must be submitted within 2 hours of purchase. Once an order is in production, changes or cancellations are no longer possible.

6) Pricing, Payments & Taxes

• Prices are shown in the currency indicated at checkout. We may change prices at any time prior to purchase completion.

• You authorize us (and our payment processors) to charge your selected payment method at order placement.

• Prices may exclude taxes, VAT/GST, and duties. Where required, applicable taxes will be added at checkout; import duties and customs fees (if any) are the buyer’s responsibility.

7) Shipping, Delivery & Risk of Loss

• We ship worldwide to most locations. Delivery estimates shown at checkout are estimates, not guarantees.

• Risk of loss passes to you upon delivery to the carrier. We are not liable for delays caused by carriers, customs, weather, or events beyond our control.

• If a package is marked “delivered” by the carrier but you cannot locate it, please contact the carrier first; we’ll assist where possible.

8) Returns, Replacements & Claims for Personalized Goods

Because most items are custom-made, they are non-returnable and non-refundable except in cases of manufacturing defects or our error.

• Defect/incorrect item claims must be submitted within 30 days of delivery with clear photos and order details.

• Upon verification, we will, at our discretion, repair, replace, or refund the affected item(s). Minor color, size, or placement variations within stated tolerances are not defects.

• If a return is authorized, items must be unused and in original condition/packaging. Unauthorized returns may be refused.

9) Content & Design Quality Standards

• Resolution: For best results, provide high-resolution files (generally 300 DPI at print size). Low-resolution or compressed files may print with visible artifacts.

• Color Management: Provide RGB files; we convert to print profiles suited to our equipment. Exact color matching to on-screen previews is not guaranteed.

• Rights & Releases: If User Content includes people, logos, artworks, or trademarks, you must have necessary permissions and releases.

10) Prohibited Uses of the Site

You may not:
(a) breach applicable laws or third-party rights;
(b) attempt to gain unauthorized access to the Site or our systems;
(c) use the Services to develop competing services;
(d) interfere with others’ use of the Site; or
(e) scrape, crawl, or harvest data without written permission.

11) Third-Party Services

We use third-party providers (e.g., Shopify, payment processors, carriers). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party acts or omissions.

12) DMCA/Notice of Alleged Infringement

If you believe content on the Site infringes your IP, please send a notice including: (i) identification of the work, (ii) the allegedly infringing material/URL, (iii) your contact details, (iv) a good-faith statement, and (v) a statement under penalty of perjury that the information is accurate and you are authorized to act.

13) Warranties, Disclaimers & Limitation of Liability

• AS-IS: Except as expressly stated in these Terms, the Site and Products are provided “as is” and “as available.” We disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement.

• No consequential damages: To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, punitive, or consequential damages.

• Cap: Our total liability for any claim arising out of or relating to the Services or products shall not exceed the amount you paid for the order giving rise to the claim.

14) Indemnification

You agree to indemnify, defend, and hold harmless EuroserPOD Store, its affiliates, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your breach of these Terms.

15) Compliance, Sanctions & Export

You represent that you are not located in, under the control of, or a national/resident of any country or person on any applicable sanctions list. You agree to comply with all export control and sanctions laws.

16) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information.

17) Changes to the Terms

We may update these Terms at any time by posting the revised version on the Site. The “Last updated” date will reflect the latest changes. Your continued use of the Services after changes become effective constitutes acceptance.

18) Governing Law & Dispute Resolution

• Governing law: These Terms are governed by the laws of the USA, without regard to conflict-of-laws rules.

• Jurisdiction: Courts of New Jersey, USA shall have exclusive jurisdiction, unless mandatory consumer protection rules provide otherwise.

• For consumers in the EU/UK, statutory consumer rights and courts of your habitual residence may apply where required by law.

19) Severability, No Waiver, Entire Agreement

If any provision is found unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. These Terms, together with the Policies, are the entire agreement between you and us regarding the Services.
